Eminent Domain Bill Still In Committee

The Senate Community and Urban Affairs Committee held a hearing concerning eminent domain legislation, S757 - Rice (D28) on May 5, 2008. The bill did not receive enough votes to pass the committee, but will be placed for a vote again on Thursday, May 15.

The bill revises current procedures for the use of eminent domain in municipal redevelopment programs. (Source: NJAR)

Eminent Domain Appeal Rejected in Lodi NJ

A New Jersey appellate panel rejected an appeal from municipal officials in Lodi to utilize eminent domain to seize private property including two mobile home communities. The decision reaffirms a 2005 Superior Court ruling that stated the evidence claiming the property as "blighted" was not strong enough to allow the municipality to seize the land for private redevelopment. The borough planned to utilize the land to create a gated senior community and upscale retail space, with a projected annual tax revenue of $3 million instead of the $250,000 currently coming in from the mobile homes.

The residents of Brown's Trailer Court and Costa's Trailer Court were backed by the grassroots organization "Save Our Homes" and New Jersey Public Advocate Ronald K. Chen in their four-year eminent domain battle.

NJ Public Advocate Released Eminent Domain Abuse Report

New Jersey Public Advocate Ronald K. Chen released a report on eminent domain abuse earlier this week, calling upon the Legislature to act swiftly to reform the state redevelopment law.

The report,
available online here for download as PDF file, is a follow-up to the Public Advocate's eminent domain report issued last May.
